Texas has moved its data-center backlash beyond electricity demand. Gov. Greg Abbott is directing water regulators to punish facilities that ignored mandatory reporting, opening the door to criminal referrals, permit consequences, and denied grid connections just as the state confronts an unprecedented queue of AI infrastructure.
Texas spent years selling itself as the natural home for hyperscale infrastructure. Now the state is discovering that it cannot reliably answer a simpler question: how much water those facilities use. The dispute has crossed from planning into enforcement.
Texas has turned missing water data into a legal problem
The policy shift is easy to miss because the underlying rule is not new. Texas has required certain large water users to answer Water Development Board surveys for years. What changed on September 14 is the state’s willingness to use the enforcement machinery already sitting in the statute.
Gov. Greg Abbott directed the Texas Water Development Board to pursue major users, including data centers, that failed to provide required water-use information. His order says those failures appear to include civil and criminal violations. It instructs the board to refer appropriate cases to county or district attorneys and to notify environmental regulators when noncompliance could disqualify a facility from water permits, amendments, or renewals.
That changes the texture of the AI-infrastructure debate. Electricity demand can be argued over in forecasts. Water reporting has a form, a deadline and, now, a threatened consequence.
The AI infrastructure fight has acquired an enforcement mechanism.
The compliance record explains the escalation. The Texas Water Development Board surveyed 341 data centers in 2025; only 17% responded. The problem worsened as the industry expanded: the number of facilities individually surveyed rose from 22 in 2023 to 341 two years later. Texas built a data-center market faster than it built a reliable picture of the water beneath it.
The grid queue makes the water gap harder to ignore
The same facilities are arriving at extraordinary scale on the power side. ERCOT is considering more than 474 gigawatts of requests to connect to the Texas grid, more than five times the system’s record peak demand. Abbott’s August order requires a comprehensive audit before data-center projects can advance through the interconnection process; projects that refuse the audit can be denied connection.
Water has now been folded into that audit. ERCOT and state regulators are being told to collect projected consumption, supply sources and cooling technologies alongside electricity requirements and ownership information. The consequence is subtle but important: a data center’s route to power increasingly runs through disclosure about water.

This is where the politics become more durable than a single permitting fight. Texas communities have been told that AI infrastructure can bring investment, construction and tax revenue. Residents are simultaneously asking whether electricity upgrades, groundwater depletion, noise and transmission costs will be socialized around those projects. The state’s information deficit makes both promises difficult to price.
The comparison to shale is revealing. A Texas water official told lawmakers in June that the rapid emergence of data-center water demand was reminiscent of the beginning of fracking: a fast-growing industry, proprietary data and regulators trying to map a resource burden after development had already accelerated.
Texas eventually built specialized databases and reporting systems around hydraulic fracturing. Data centers may be entering the same institutional phase.
The constraint is no longer merely megawatts
The popular model of the AI buildout is a race for chips, transformers and generating capacity. Texas is adding another scarce input: permission.
That permission now depends on something unusually mundane for an industry valued in trillions of dollars — completing a water survey. If regulators follow through, facilities that treated disclosure as optional could face prosecution referrals, permit complications or blocked grid access. In a state competing to host the next generation of compute, paperwork has become part of the infrastructure stack.
The broader lesson is not that Texas has turned against AI. It is that industrial abundance eventually collides with accounting. The first phase of the boom asks how quickly a state can build. The second asks what the build consumes, who pays for it and whether anyone kept count.
In Texas, that second phase has begun.
